Your Legal Rights Under Workers' Compensation*

Injuries and Accidents. Any work-related injury, accident, or disability may make you eligible for workers' compensation benefits.

Worsening. If work worsens a pre-existing physical or mental problem, you may be entitled to workers' compensation benefits.

Back and Shoulder Injuries. These are common injuries from vacuuming, pulling trash, and other activities. You may receive benefits, even if you had prior work or non-work related back and shoulder injuries.

Chemicals. Problems from cleaning compounds, such as rashes, headaches, dizziness, and nosebleeds may entitle you to benefits. (You should also contact the Union or file a complaint with the Washington Department of Labor C 281-5470.)

Emotional Stress. Emotional stress caused by your job may also make you eligible for benefits.

Time to File. You have up to one (1) year after an injury and two (2) years after getting a work-caused illness to file. But it is better not to wait.

Benefits. Possible benefits include weekly payments, hospital and medical bills, rehabilitation, retraining, and more.

Protection. If your boss retaliates after you've filed a complaint or claim, contact the Department of Labor and they will take action.

Doctor. You have the right to use your own doctor, not the company's. The doctor will not charge you, but will send the bill to Workers' Compensation.

Attorney. You have the right to select your own lawyer. Choose a specialist in Workers' Compensation. The attorney's fee is decided by the judge and is paid out of the judgment. If you do not win your case, there is no charge to you. For referrals to Workers' Compensation lawyers, call:

If you are injured. Tell your supervisor immediately. Ask for and fill out a claim form.

Right to sue. Workers' Compensation does not prevent you from suing "third parties" (people other than your boss, such as building owners) who are responsible for your injury.
